التمذهب الفقهي بين الملزمين والرافضين

Abstract

تهدف هذه الدراسة إلى بيان معنى التمذهب الفقهي، ومن يدخلون تحت مصطلح التمذهب الفقهي، مع سرد أقوال الفقهاء والأصوليين في حكم التمذهب الفقهي، وبيان أدلة كل فريق منهم مع مناقشتها إن وجدت، ثم بيان المذهب الراجح في المسألة، في دراسة موضوعية بعيدة عن كل أشكال النمطية، وقد خلصت الدراسة إلى أن التمذهب خاص بالمجتهدين، أو من هو دونهم ممن ارتقى عن رتبة العامي، وتوصلت الدراسة أيضا إلى أن المذهب الوسط في المسألة، وهو مذهب المجيزين للتمذهب هو المذهب الراجح وهو مذهب الأكثر، كما أن البعض من كلا الطرفين قد سلكوا مسلك الغلو، إما بالتعصب المذهبي للملزمين بالتمذهب، أو التعصب اللامذهبي للرّافضين للتمذهب، وكلا الأمرين مردود.
