تحرير محل النزاع في البحث العلمي الشرعي: مفهومه ،ضرورته، وأثره

Abstract

الملخص: يمكن لكلِّ مختلفين الرجوع إلى مقدمة مشتركة بين رأييهما، ثم يختصُّ كلُّ بما يميِّز رأيه؛ وقد اصطُلح على هذا الاختصاص ب" محلّ النزاع "، الذي يُعتبر الوقوف عليه تحقيقا أهمَّ مراحل البحث الخلافي، من خلال عملية عرفت ب " تحرير محلّ النزاع "، في هذا البحث تعرّضت لهذه العملية بالتعريف . ثمَّ بينت أن الغاية منها: حصر صورة الخلاف بالتحديد لأجل أن تتوارد عليها الأدلة، فلا يتشتت الحجاج عن محزِّ النظر، كما سقت نماذج مختلفة لطرق العلماء في تحرير محلَّ النزاع. ولأجل بيان ضرورة هذه العملية في البحوث الخلافية، أبرزت الأهمية البالغة التي تكتسبها ضمن مراحل البحث العلمي والتي جعلتها ضرورة بحثية حتمية متصدِّرة، حفظا لوقت الباحث، وصونا للفعل الفكري الإنساني من العبث، ثم ختمت بتفصيل الآثار الموضوعية والصناعية لتحرير محل النزاع في البحث الشرعي وفن الجدل . تلكم الآثار التي لن يدركها الباحث والمحاور إلا بالوقوف طويلا يحرّر محزًّ الخلاف ويقرَّب شقته . Abstract : Each of the two differences can refer to a common denominator between their opinions, which may end up with mental axioms, and then each one of them uses what distinguishes his opinion, to refer to this competence as the "subject of dispute," which is the most important phase of research on controversies, through an advanced process known as "the liberation of the subject of dispute," in this research, I was exposed to this process by defining a deconstruction of the additive compound vocabulary expressed and then by defining its concept. Then I explained that the aim of this operation is to limit the image of the dispute specifically in order to contain evidence, so that pilgrims do not get distracted from the meritorious aspects, and I also cited different models of the scientists' work in liberating it. In order to demonstrate the need for attention to this process in controversial research, I was exposed to a statement of the critical importance of the liberation of the conflict in the stages of scientific research, which made it an imperative for research; in order to protect the researcher's time, he spends without any significant return of knowledge, and to protect the intellectual human act from tampering. Then, I concluded with detailing the objective and industrial effects of liberating the cause of conflict in terms of legitimate research and the art of controversy. These effects, which the researcher and interlocutor will only realize by standing for a long time, will liberate the heart of disagreement and bring closer his distance.
