المحكمة الدستورية في التعديل الدستوري 2020 " بين الرقابة السياسية والرقابة القضائية"

Abstract

اعتمد التعديل الدستوري الجزائري لسنة 2020، على المحكمة الدستورية كمؤسسة مكلفة بالرقابة على دستورية القوانين، بدلا عن المجلس الدستوري، للحفاظ على سمو الوثيقة الدستورية، وحماية الحقوق والحريات . لذلك لابدّ، من تحديد طبيعة الرقابة التي تمارسها هذه المحكمة، إن كانت رقابة سياسية أو رقابة قضائية، والتي يلاحظ أنها ذات طبيعة هجينة، تجمع بين الرقابة السياسية و الرقابة القضائية. Abstract: he Algerian constitutional amendment of 2020, relied on the Constitutional Court as an institution charged with monitoring the constitutionality of laws, instead of the Constitutional Council, to preserve the primacy of the constitutional document and protect rights and freedoms. Therefore, it is necessary to determine the nature of the oversight exercised by this court, whether it is political oversight or judicial oversight, What is noted is that the Constitutional Court is of a hybrid nature, combiningboth political and judicial oversight.
