الاستثمار الوقفي بين الضوابط الشرعية والمعايير الاقتصادية والمالية

Abstract

تتناول هذه الورقة البحثية أحد الركائز الأساسية لنظام الوقف في الإسلام ألا وهو الاستثمار الوقفي، حيث يعدّ الأداة الفاعلة لتنمية الوقف وتمويله وحيويته؛ ومن أجل الحفاظ على تأمين الفرد والمجتمع وضمان سيرورة الحياة الاجتماعية والاقتصادية، أوجبت الشريعة الإسلامية جملة من الضوابط الشرعية لاستثمار الوقف درءًا للمفاسد التي تحول دون تحقيق مقاصده، كما وضع علماء الاقتصاد عددا من المعايير الاقتصادية والمالية التي تُبْعِدُ إدارة العملية الاستثمارية عن دائرة المخاطر، فجاءت هذه الدراسة في ثلاثة مباحث، تضمّن المبحث الأول الاطار المفاهيمي لمصطلحات البحث(الاستثمار الوقفي- الضوابط الشرعية- المعايير الاقتصادية والمالية)، وتطرق المبحث الثاني لبيان الضوابط الشرعية للاستثمار الوقفي، أما المبحث الثالث فذكر المعايير الاقتصادية والمالية المتعلقة باستثمار الوقف، وقد اتبعت الدراسة المنهج الوصفي من خلال تحديد مصطلحات البحث، والمنهج التحليلي من خلال الوقوف على أهمّ الضوابط والمعايير التي تلازم الاستثمار الوقفي، وتوصلت الدراسة إلى نتائج أهمّها: ضرورة الالتزام بالضوابط الشرعية والمعايير الاقتصادية والمالية في عملية الاستثمار الوقفي تحقيقا للعائد الايجابي للاستثمار، وتجنبا للوقوع في المخاطر التي تضرّ بأصحاب المصارف الوقفية، كما أوصت الدراسة بنشر ثقافة الوعي الوقفي لإحياء سنة الوقف وتطويره وتجديده واستثماره في الحياة This paper deals with one of the main pillars of the waqf system in Islam, namely waqf investment It is an effective tool for the development of the waqf, its financing and vitality. To maintain the security of the individual and society and ensure the process of social and economic life, Islamic sharia has imposed a number of Islamic controls to invest the waqf to avoid the corruption that prevents the achievement of its purposes. Scholars has developed a number of economic and financial criteria that keep the management of the investment process away from the risk circle. Hence, this study contains three fields of research: the first is a conceptual framework of research terminology (waqf investment - sharia controls - economic and financial standards), the second field dealt with the legal controls of waqf investment, while the third one mentioned the economic and financial criteria related to the investment of waqf. The study adopted the descriptive approach through the identification of research terms, and the analytical approach through Identifying the most important controls and standards that govern the investment. The main findings of the study are: The need to adhere to sharia controls and economic and financial standards in the process of investment endowment in order to achieve the positive return on investment, and to avoid falling into risks to the owners of the banks endowment, as recommended by the study to spread the culture of awareness of endowment to revive, develop, renew and invest in life.
