القتل الرحيم بين الشريعة الإسلامية والقانون الوضعي

Abstract

تلقي هذه المذكرة الضوء على موضوع القتل الرحيم بين كل من الشريعة الإسلامية والقانون الوضعي، والتكييف الفقهي والقانوني له، دون الإخلال بماهيته، إذ أن الشريعة الإسلامية أجزمت على تحريمه، خلافا للقانون الوضعي الذي تختلف فيه الآراء بين المؤيدين والمعارضين له، أما من ناحية المسؤولية الجنائية فقد وضعت كل من الشريعة الإسلامية والقوانين المعارضة للقتل الرحيم مسؤولية جنائية يجب على مرتكبه تحملها، مع ملاحظة توافق كل منهما في جزئية رضا المجني عليه، إذ اعتبرته الشريعة الإسلامية شبهة تدرأ عن صاحبها القصاص، واعتبرته القوانين الوضعية ظرفا مخففا للعقوبة.
