دور تقسيمات المنشآت المصنفة في حماية البيئة من التلوث في التشريع الجزائري

Abstract

ملخص: يتناول موضوع البحث دراسة التقسيمات الرئيسية التي أوردها المشرع الجزائري للمنشآت المصنفة تميزا وتفردا لها، لتفادي وقوع أي غموض قد يقع بين مختلف فئاتها، سواء من حيث درجة تأثيرها على البيئة، أو من حيث الإجراءات الخاصة بكل فئة على حدى، وقد تم تحديد هذه التقسيمات في مختلف المراسيم التي تنظم المنشآت المصنفة، وكذا في قانون البيئة، مما يعني أن الفرد مقيد في إنشائه للمنشآت المصنفة، بحيث لا يجوز له أن يقوم بإنشاء منشأة ما إلا إذا راعى مجموعة من المعايير والاعتبارات كنسبة المخاطر المحتملة التي يمكن أن تنتج عنها مثلا، أو النظام الذي تخضع له كل فئة. Abstract The research subject deals with the study of the main divisions which were provided by the Algerian legislator for the classified facilities considered as distinct and unique to avoid any ambiguity that may occur between its different categories, whether in terms of their degree of impact on the environment or in the form of procedures for each category separately. These divisions have been actually identified not only in the various decrees that regulate the classified facilities, but also in the environment regulation. This means that individuals are restricted in the creation of the classified facilities to the extent they are forbidden to undertake any facility unless a number of requirements are fulfilled. These criteria might be, for example, the potential risks that they may engender or the system that each category is subsumed to.
