Abstract

" الملخص تناولت هذه المذكرة موضوع المصلحة المرسلة وأثرها في المعاملات المالية, انطلاقا من الاشكالية الآتية: ما هي الاثار المترتبة على المصالح المرسلة في المعاملات المالية؟. و للإجابة على هذا التساؤل احتوى البحث على الخطة الآتية: والتي تنقسم الى مبحثين الأول كان مبحثا نظريا لبيان حقيقة المصلحة المرسلة و أما بالنسبة لثاني فكان مبحثا تطبيقيا يتضمن ذكر بعض المسائل في البيوع و ما شكلها من قضايا المعاملات المالية وخاصة المعاصرة منها. وفي الاخير توصلت الدراسة الى أهم النتائج: إن المصالح المرسلة لها أثر كبير في حفظ مصالح العباد ورفع الحرج ودرء المفاسد عنهم، كما لها دور فعال في تيسير العديد من الأحكام.
