الآليات القانونية للتسوية القسمة القضائية العقاريــة في التشريع الجزائري

Abstract

يثير المال الشائع العديد من المشاكل في الحياة العملية فهو حالة غير مرغوب فيها تتشابك فيها سلطات الشركاء على العقار الشائع بينهم ،ويبقى الحل الأمثل لإنهاء هذه المشاكل و إزالة الشيوع القسمة القضائية بإعتبارها وضع من الأوضاع القانونية التي أقرها المشرع للفصل في كل خصومة يمكن أن تنشأ بين الشركاء في الشيوع بشأن هذه الملكية أو لوجود قاصر بين الشركاء طالبي القسمة القضائية. يهتم هذا البحث بدراسة الآليات القانونية التي أقرها المشرع الجزائري لتسوية القسمة القضائية ، فهي حق مكفول بموجب القانون ،لأنه يمثل الوسيلة الأنجع لإزالة الشيوع لما تحويه من حل للنزاعات والمشاكل التي يثيرها هذا الأخير .
