أحكام تغير جنس الانسان بين الشريعة الاسلامية والقانون الوضعي

Abstract

لقد ظهرت حديثا على أرض الواقع إمكانية طبية تتمثل في تغيير جنس الإنسان، من ذكر إلى أنثى أو من أنثى إلى ذكر، إذ يستطيع شخص ما تغيير جنسه إلى جنس معاكس له برغبة منه، لكونه مصاب بمرض اضطراب الهوية الجنسية، وذلك بإجراء عملية جراحية لتغيير جنسه، ويعد هذا الفعل اعتداء على حرمة الكيان البشري، مما يثير تساؤلات عن مدى مشروعية فعل التغيير من ناحية الشريعة الإسلامية والقانون الوضعي،وحول الآثار التي يثيرها فعل التغيير من إشكالات في الشريعة الإسلامية والقانون الوضعي وبيان نتائجها الاجتماعية و النفسية. Summary: The ground has appeared medical possibility is to change the human sex from male to female or female to male, as can someone who change his sex to the opposite sex of his desire to him, for being infected with gender identity disorder, and by making an operation to change his sex, and this is act and an assault on sanctity the human entity ,which raises questions about of the lawfulness of an act on one hand Islamic law, and positive law, and about the effects raised by the reaction of the change is confused about Islamic law and positive law and the statement of the social and psychological results .
