ضمانات المنتفعين من مرفق توزيع الكهرباء والغاز في ظل عقد الامتياز

Abstract

يعتبر مرفق توزيع الكهرباء والغاز من نشاطات المرفق العام، التي ظلت لمدة طويلة تسير عن طريق المؤسسة العامة، إلى غاية صدور القانون رقم 02-01 والمتعلق بالكهرباء وتوزيع الغاز بواسطة القنوات والذي نص على تسيير هذا المرفق عن طريق عقد الامتياز. غير أن هذا التحول في طريقة التسيير، طرح إشكالية احترام مقتضيات المرفق العام، وضمان حقوق المنتفعين من هذا المرفق، ومن أجل تجاوز هذه العوائق، أنشأت سلطة إدارية هي لجنة ضبط الكهرباء والغاز، والتي تعمل على الرقابة والتحسين المستمر في تقديم خدمات ذات نوعية رفيعة ومؤكدة على الضمانات التي يجب أن يتمتع بها المنتفعين من هذا المرفق الحيوي.؛ The electricity and gas distribution facility is one of the public utility activities that for a long time have been managed by the public institution until the promulgation of Law No. 02-01 relating to electricity and gas distribution by conduits, which stipulated the operation of this facility through a concession contract. However, this shift in management method raised the problem of respecting the requirements of the public utility and ensuring the rights beneficiaries of this facility. In order to overcome these obstacles, an administrative authority was established, the Electricity and Gas tuning Committee, which works on monitoring and continuous improvement in providing services with high quality and confirming the guarantees that the beneficiaries of this vital facility should have.
