التنظيم القانوني للاستثمار الوقفي في الجزائر -الواقع والمأمول

Abstract

اعترافا من المشرع الجزائري بأهمية الاستثمار الوقفي ودوره في تنمية الأملاك الوقفية والمحافظة عليها جاء قانون 01 – 07 المعدل والمتمم لقانون الأوقاف رقم 91 - 10 لتكريس عدم الاكتفاء في إطار المحافظة على الأملاك الوقفية وحمايتها باستغلالها، بل ضرورة تجاوز ذلك إلى استثمارها وتنميتها، وذلك بتحديد صيغ الاستثمار الوقفي أي الوسائل التي من خلالها يتم استثمار الأملاك الوقفية. غير أن واقع الاستثمار الوقفي في الجزائر يبدو قاصرا عن أداء الدور التنموي المنوط به، مما يستدعي توضيح وتشخيص جوانب القصور في التنظيم القانوني للاستثمار الوقفي في الجزائر، باعتبار ذلك القصور في وجهة نظر الباحث عاملا أساسيا في ركود الدور التنموي الذي يمكن أن يساهم به نظام الوقف في الجزائر، ومن ثم تصور لبعض الحلول والبدائل التي من شأنها المساهمة في تدارك الوضع. In recognition of the Algerian legislature of the importance of investing the endowment and its role in the development of Waqf properties and maintain them came the Law 01-07 as amended and supplemented to the law of Waqf No. 91-10 to devote not only in the context of maintaining the Waqf properties and protection to exploit , but need to go beyond that to invest and develop , by selecting formats of investing endowment in other words the means by which the endowment is an investment property . This research Comes to clarify the diagnosis and shortcomings in the legal regulation of the endowment investment in Algeria , as deficiencies in the researcher 's point of view a key factor in the stagnation of the developmental role that can contribute to its endowment system in Algeria ;then imagine some solutions and alternatives that will contribute to remedy the situation .
