Abstract

"الملخص فك الرابطة الزوجية مفهوم شامل لكل أنواع الطلاق, اقتصرنا فيه على موضوع ""التطليق"", وقد ركزنا فيه على الإطار المفاهيمي للتطليق, وكذا الإجراءات والآثار المترتبة عليه, كما تضمن صلب موضوعه الإجابة عن الإشكال الذي طرح؛ والذي مفاده إلى أي مدى توافق المشرع الجزائري مع الفقه الإسلامي في مسألة التطليق؟ بحيث توصلنا إلى أن هناك توافق إلى حد بعيد بين ما نص عليه المشرع الجزائري وما جاءت به الشريعة الإسلامية فيما يخص التطليق إلا في بعض الشروط والأحكام، مثل قانون التعدد. " Abstract: The dismantling of the marital bond is a comprehensive concept of all types of divorce, in which we have focused on the subject of ""divorce"", in which we focused on the conceptual framework of divorce, as well as the procedures and implications of it, as well as the crux of its subject to answer the problem that has been raised, which is to what extent is the compatibility of the Algerian legislator with Islamic jurisprudence on the issue of divorce? We have come to the conclusion that there is a great consensus between what the Algerian legislator stipulated and what islamic law says with regard to divorce except in certain terms and conditions, such as the law of pluralism.
