اليسير المغتفر وتطبيقاته الفقهية في باب المعاملات المالية -دراسة فقهية بيقية-

Abstract

هذه الدراسة الموسومة ب " قاعدة اليسير المغتفر وتطبيقاته الفقهية في باب المعاملات المالية"، وأثرها في عقود المعاوضات والتبرعات، وكان الإشكال الرئيس فيها هو: ماهو مفهوم قاعدة اليسير المغتفر، وما أثر تطبيقاتها الفقهية في باب المعاملات المالية؟ وقد سعينا للإجابة عن هذا الإشكال من خلال ثلاثة مباحث: مفهوم القاعدة ودليلها وضوابطها، عقود العاوضات والتبرعات، الغرر والغبن وأثرهما في عقود المعاوضات والتبرعات. وقد توصلنا إلى جملة من النتائج أهمها: قاعدة اليسير المغتفر متفرعة عن القواعد الكلية الفقهية الكبرى، المتعلقة بالتيسير ورفع الحرج، تحديد مقدار اليسير والكثير من المشقة، مرده الى الثلث عند السادة المالكية، وإلى العرف عند الجمهور، الغبن والغرر اليسير عماد تطبيق الفقهي لقاعدة اليسير المغتفر في باب المعاملا ت الماليةThis study is titled "The Forgiven Ease Rule and its Jurisprudential Applications in the Financial Transactions Section", and its impact on exchange contracts and donations.
