التعليل المقاصدي عند الشاطبي

Abstract

د تطرّقْتُ في هذا البحث الموسوم بـ: "التعليل المقاصدي عند الشاطبي" إلى محاور عدة، تمثلت في محاولة معرفة المقصود بالعلّة عند الشاطبي؛ وعلاقتها بالمقاصد؛ من أجل معرفة مفهوم التعليل المقاصدي عنده، ومن ثمّ تحديد مجاله. وبعد استخدام المنهج الاستقرائي والتحليلي؛ توصلتُ إلى بعض النتائج؛ أهمها الآتي: 1. التعليل المقاصدي عند الشاطبي هو تعيين لمقاصد الأحكام، والتي يعتبرها العلل الحقيقية للأحكام، وهذا مطّرد في جميع أحكام الشّريعة، واطّراده أظهر ما يكون في أحكام العادات والمعاملات. 2. لا ينكر الشاطبي تعليل العبادات، وأنها لا تخلو من مقاصد جملة وتفصيلا، ولكنه يجعل الأصل فيها التعبد لا التعليل، وهو نفي العلل الخاصة التي تصلح أساسا للقياس لا نفي التعليل بمعناه المصلحي العام الذي لا يخلو منه حكم شرعي I In this research, entiteled ender: "Al-Shatiby's Intentional Reasoning", I have tackled several axes; starting with the spotting of Al-Shatiby's Reason; and Its relationship whith the Purposes, In Order To conceptualyze his Concept, And Then Define Its Scope. After Using The Inductive And Analytical Method; my most significant findings were: 1.The Intentional Reasoning Of Al-Shatibi Is The Identification Of The judgments’ Purposes, which he considers to be the guenuine causes. 2.Al-Shatibi does not deny the justification in Worship, which is all meant for pupose. Yet he puts its core (Worship) in devotion instead of Rasosoning. He only denies special causes, from which we extract Analogy,instead of the denial of reasoning in its meaning of common sake, that is not empty of any religious judgment.
