Abstract

This study dealt with an important issue concerning the jurisprudence of the family, namely, the question of the legal viability of man in the perspective of the modernist trend according to the modern perception of the issue and its texts and discussing and explaining the causes and effects resulting from this perception. The study found that the legal guardianship from the point of view of jurists and interpreters is the man's care for women's material and moral affairs, And that all the contradicts this saying that the mistake is illegitimate and is not acceptable because it is contrary to common sense and the correct mind and the frequency of the texts of the Quran and the theSunna of Mustafa P.B.U.H in preserving the dignity of women
