المبادئ الدستورية التي يقوم عليها القضاء الجزائي في توفير الأمن القضائي حسب ما جاء في التعديل الدستوري لسنة 2016 والصادر بالقانون 16-01

Abstract

- باللغة العربية : للقضاء دور مهم في تحقيق وتوفير الأمن و يستجد ذلك بتحقيق العدل من طرف جهاز العدالة الذي يقوم على عدة مبادئ قانونية دستورية سواء كان ذلك يتعلق بالتنظيم القضائي في حد ذاته وكذا المبادئ التي تخص المحاكمات تطبيقا للمبادئ الدستورية التي تكفل الحقوق وتصن الحريات في دولة القانون وكذا السلطة القضائية بما لها من استقلالية حيث هي الأخرى تقوم على مبادئ تجعل عملها دائما شرعيا يهدف إلى توفير الأمن القضائي وكسب ثقة المواطنين في جهاز العدالة بحيث يشعر الأفراد بالحماية القانونية لحقوقهم ومصالحهم وبالتالي حماية المجتمع من الصراعات والصدمات الفردية وعدم التفكير في العدالة الخاصة داخل الدولة بمفهومها الحديث . 2- باللغة الانجليزية : The judiciary has an important role in achieving and providing security. This is due to justice by the justice system, which is based on several constitutional legal principles, both in terms of the judicial organization itself, as well as the principles related to the trials in accordance with the constitutional principles that guarantee rights and protect freedoms in the state of law. The judiciary with its independence is also based on principles that always make its work legitimate. It aims at providing judicial security and gaining the confidence of citizens in the justice system so that individuals feel the legal protection of their rights and interests and thus protect the community from conflicts and .individual shocks and not to think about the special justice within the state in its modern sense
