| dc.description.abstract | الملخص: الغالب أن تنتهي الخصومة القضائية بالطريق الطبيعي و ذلك بالفصل فيها و صدور حكم فيها ينهيها، إلا أنه في بعض الأحيان قد تعترض الخصومة القضائية بعض العوارض تحول دون مواصلة تسلسل إجراءاتها، فتحول دون تحقيق الغاية المرجوة منها و هي الفصل في القضية سواء لصالح المدعي أو المدعى عليه، و هذا كله ما يصطلح عليه بعوارض الخصومة القضائية. كما رتب المشرع الجزائري جزاءات إجرائية على تخلف القيام ببعض إجراءات الخصومة القضائية أو القيام بها خارج المواعيد القانونية، و هو ما يؤدي إلى بطلان الإجراءات المتخذة فيجب على الخصم تصحيحها و استدراكها إن كانت مواعيدها القانونية لم تنقض بعد أو قد تسقط نهائيا، و بالتالي قد يفقد الحق في تصحيحها كحالة مرور الموعد المقرر قانونا للاستئناف أو الطعن بالنقض. الكلمات المفتاحية: - الإجراءات، - الخصومة القضائية، - عوارض الخصومة، - سقوط الخصومة.
