Abstract

لقد تناول هذا البحث موضوع دراسة المسائل التي خالف فيها ابن القاسم شيخه الإمام مالكا في بابي الأسرة والمعاملات المالية، وقد احتوى ثلاثة مباحث وخاتمة؛ مبحثا تمهيديا تناولت فيه تعريفا جدّ مختصر بنسب ابن القاسم ومكانته الفقهية وتعدادا لمسائل الخلاف بينه وبين شيخه من خلال المدونة، أما المبحث الثاني فقد تضمن أربعة نماذج لمسائل الخلاف بين الإمامين في باب الأسرة؛ وهي: حكم وضع الأب شيئا من صداق ابنته البكر وأثر السفر في صوم كفارة الظهار وحكم الوكالة في الزواج وخلع المريضة مرض الموت، أما المبحث الثالث فقد تعلق بأربعة نماذج من باب المعاملات المالية، وهي: حكم الشركة بالطعام وحكم استئجار الأطباء وحكم معاملات الذمي قبل إسلامه وحكم الشفعة فيما تتعذر قسمته، أما الخاتمة فقد احتوت جملة من النتائج والتوصيات. This research dealt with the subject of studying the issues in which Ibn al-Qasim disagreed with the sheikh of the imam Malik in the family and financial transactions. It included three topics and a conclusion; a preliminary study which dealt with a very brief definition of Ibn al-Qasim and his jurisprudential standing, and a number of issues of disagreement between him and his sheikh through his book "Al-Modawana". But the second topic contains four examples of the issues of disagreement between the two imams in the chapter of the family. These are: Ruling on placing the father from the marriage of his eldest daughter and the effect of traveling in fasting the expiation of the " Dhahar" and the ruling of the agency in marriage and removing the sick from death, The third topic related to four models of financial transactions. company's ruling on food and the rule of hiring doctors and ruling the transactions of the incentive before his Islam and the ruling on pre-emption while the division can not be concluded, but the conclusion contains a number of conclusions and recommendations.
