ثيقة المدينة : الإعلان النبوي لحقوق الإنسان دراسة مقارنة مع الإعلان العالمي لسنة 1948

Abstract

كانت الهجرة النبوية هي مرحلة انتقال للفكرة الإسلامية من مرحلة الدعوة إلى مرحلة الدولة، وكان يجب رسم الملامح العامة بوضوح للرؤية السياسية المتعلقة بهذا الكيان الجديد، فكتب النبي صلى الله عليه وسلم وثيقة سياسية سمتها المراجع بالصحيفة، وهي كنز سياسي يدل على تقدم التجربة الإسلامية ورقيها من بداياتها الأولى، والحقيقة أنها ليست وثيقة دستورية فقط، بل إعلانا نبويا كميثاق مكتوب عن حقوق الإنسان، فجاءت الدراسة لعصر واستخراج هذه الحريات والحقوق المكتوبة في السنة الأولى هجرية ومقارنتها بما توصل له الفكر الإنساني الحقوقي في الإعلان العالمي لحقوق الإنسان لعام 1948م والذي صار توافقا عالميا جاء بعد أزمة مريرة من الحروب التي مرت بها الإنسانية. The Prophet's migration (Hijra) was a stage of transition of the Islamic idea from the stage of the “calling to Islam” (Da’awa) to the stage of “the state”, and the general features of the political vision related to this new entity should be clearly drawn. The Prophet, peace be upon him, wrote a political document that the references called “The paper” (Sahifa), which is a political treasure that indicates the progress and advancement of the Islamic experiment from its early beginnings. The truth is that it is not just a constitutional document, but rather a prophetic declaration as a written charter on human rights. The study came to extract these freedom values that written in the first Hijri year and compare it to what the human mentality reached in the Universal Declaration of Human Rights in 1948, which became a global consensus that came after a critical crisis caused by the wars that humanity went throug
