مسؤولية السلطات الإدارية في ضمان تنفيذ المقررات القضائية

Abstract

إن النتيجة المرجوة من إصدار المقررات القضائية هو تنفيذها،فلا معنى لمقرر قضائي يبقى دون نفاذ، وتجسيدا لهذا فإن المشرع حمل السلطة الإدارية مسؤولية ضمان تنفيذ هذا الالتزام، فهي ليست ملزمة فقط بتنفيذ ما صدر ضدها من مقررات بل مطالبة أيضا أن تضمن للمحكوم له أيا كان تنفيذ ما بين يديه من مقررات قضائية، فكل مقرر تتوفر فيه شروط التنفيذ واجب تنفيذه احتراما لحجية الشيء المقضي فيه، والهدف من هذا هو تفادي أن تتزعزع ثقة المتقاضي في القضاء، ويترتب عن الإخلال بهذا الواجب تبعات على عاتق المكلف بالتنفيذ، فإن كان موظفا طالته مسؤولية جزائية ومدنية، وإن كان سلطة عمومية توجب عليها دفع تعويضات للمحكوم له المتضرر. The desired result of judicial decisions is their execution. Because, there is no meaning for a judicial decision without putting it into effect. This is why the legislator guarantees the responsibility of the administrative authority in the execution of these decisions. More than that, it is obliged to help the opposing party as long as the conditions for execution are available, in according with the status of res judicata. The aim of all this is to avoid undermining the litigant's trust in the judiciary. However, in the case of a breach of the duty of execute judicial decisions the executor shall have criminal and civil liability if he is or she is an employee, but if it is a public authority, it must pay compensation to the opposing party affected by the breach.
