    إستراتيجية المشرع الجزائري في مواجهة الجرائم السيبرانية التي تهدد أمنها السيبراني

    إهتمت هذه الدراسة بالإستراتيجية التي وضعها المشرع الجزائري في التصدي للجرائم السيبرانية التي تهدد أمنها السيبراني, والتي تركت أثارها خاصة على مستوى الأمن الوطني, لأن الجزائر وبموقعها الإسترتيجي تعد مجالا مفتوح الإتجاهات ومركزا حيويا مغاربيا, ومتوسطيا, وإفريقيا, وهذا بدوره أدى إلى إختراقات وتجسسات عديدة بداية من أمن الأشخاص, مما جعل حياتهم وخصوصياتهم ملاذ للإبتزاز, سواء كان مسئولا أو مواطنا عاديا, ليتعدى الأمر بالتجسس والتهديدات التي لم تسلم منها المؤسسات الحكومية والأمنية والعسكرية في البلاد, وهذا مما أدى إلى دق ناقوس الخطر لإعادة وضع حواجزتقنية لمنع هذه التجاوزات والهجمات التي تمس بالأمن الوطني, لذلك نطرح الإشكالية التالية: ماهي الإستراتيجية القانونية التي وضعها المشرع الجزائري لمواجهة تهديدات الجرائم السيبرانية ومخاطرها ؟ Abstract: This study focused on the strategy developed by the Algerian legislator in confronting cybercrimes that threaten its cybersecurity, which left its effects, especially at the level of national security, because Algeria, with its strategic location, is considered an open field and a vital center in the Maghreb, the Mediterranean, and Africa, and this in turn led to hacking and espionage. Many things, starting with the security of people, making their lives and privacy a haven for blackmail, whether an official or an ordinary citizen It goes beyond espionage and threats from which governmental, security and military institutions in the country were not spared. This led to sounding the alarm to re-establish technical barriers to prevent these transgressions and attacks that affect national security. Therefore, we pose the following problem: What is the legal strategy that the Algerian legislator has developed to confront the threats of cybercrimes? And its risks?

    ان ظاهرة جرائم الكمبيوترأ والانترنت،او جرائم التقنية العالية ، او الجريمة الإلكترونية كما يطلق عليها، هي ظاهرة إجرامية مستجدة نسبيا ، وجاء تطوّر هذا النوع من الجرائم بالتزامن مع التطورات التي طرأت على التقنيات والتكنولوجيا التي يسرت سبل التواصل وانتقال المعلومات بين مختلف الشعوب وسهلت حركة المعاملات الإجرامية باستخدام شبكة المعلوماتية كوسيلة سهلة لتنفيذ العمليات الإجرامية ، مما يلحق أضرر بالآخرين ، من هنا سعى المشرع الجزائري إلى سن العديد من التشريعات والقوانين للتصدي لهذه الجرائم Abstract: The phenomenon of computer and Internet crimes, or high-tech crimes, or electronic crime as it is called, is a relatively new criminal phenomenon, and the development of this type of crime came in conjunction with the developments that occurred in techniques and technology that facilitated the means of communication and the transfer of information between different peoples and facilitated the movement of transactions. Criminal crimes use the information network as an easy means to carry out criminal operations, causing harm to others. Hence, the Algerian legislator sought to enact many legislations and laws to combat these crimes.

    معوقات وتحديات الأمن السيبراني

    في ظل التوجه الدولي نحو الحكومة الإلكترونية أصبحت قضية الأمن المعلوماتي السيبراني من التحديات الكبرى على الصعيدين الإقليمي والعالمي، لا سيما مع تزايد التهديدات الأمنية الإلكترونية،والجزائر كغيرها من الدول سعت منذ انتهاجها للإدارة الإلكترونية حماية منظومتها المعلوماتية من خلال العديد من الأجهزة والخلايا الأمنية. لقد أصبح الأمن المعلوماتي السيبراني ركن أساسي ضمن المنظومة الأمنية المعاصرة، والتي يجب على الدفاع الوطني من خلال أجهزته كاالامن الوطني,و الدرك الوطني الجزائري باعتباره مسؤول أمني داخلي تحقيقه في ظل تنامي الجريمة الرقمية، وكذا نظرا للاستغلال المتنامي للشبكة العنكوبتية للأهداف إجرامية،والتي تؤثر سلباً على سلامة البنى التحتية للمعلومات الوطنية الحساسة خاصة على المعلومات الشخصية. وعليه جاءت هذه الورقة البحثية لمعالجة وتحليل معوقات وتحديات الأمن السيبراني Abstract In light of the international trend towards e-government, the issue of cyber information security has become one of the major challenges at the regional and global levels, especially with the increase in electronic security threats. Algeria, like other countries, has sought since its adoption of electronic management to protect its information system through many security devices and cells. Cyber information security has become an essential pillar within the contemporary security system, which the National Defense, through its agencies such as the National Security, and the Algerian National Gendarmerie, as an internal security official, must achieve in light of the growing digital crime, as well as in view of the growing exploitation of the spider network for criminal targets, which has a negative impact. On the safety of sensitive national information infrastructure, especially information Personal. Accordingly, this research paper came to address and analyze the obstacles and challenges of cybersecurity.
