    لقد جاءت الشريعة الإسلامية لجلب المصالح وتحقيقها، ودفع المفاسد وتعطيلها فأحكمت تشريعاتها أيما إحكام لتشمل البشرية جمعاء على مختلف الأحوال والأزمان. ولقد تفشت جريمة الاغتصاب بأشكال وصور تخرجها عن وصفها بجريمة الزنى، لذا كان لابد من الوقوف على التكييف الفقهي لهذه الجريمة وعقوبتها في الفقه الإسلامي، تنبيها على انتشارها وخطورتها وخطورة ما يرافقها من آثار. Islamic sharia aimed at bringing benefits and warding off evil, its legislation is exact, and it includes every humanity on different circumstances and times. The crime of rape has spread through different forms, which differ from adultery, so it was necessary to address the jurisprudential characterization of this crime and its punishment in Islamic jurisprudence
