    تحديث المرفق العام عن طريق التفويض في الجزائر

    تهدف هذه الدراسة إلى تحديد الإطار العام لتقنية تفويض المرافق العامة في الجزائر, كمفهوم جديد ومستقل يؤطر مجموعة من العقود وفق مرتكزات قانونية, راهنت عليه من أجل توسيع الاستثمار في مجال المرفق العام, وذلك تأثرا بالتجربة الفرنسية والتي عرفت مرافقها العمومية تنمية جد فعالة منذ اعتماد هذا الأسلوب في التسيير وذلك لكونه يحقق العديد النتائج الإيجابية. و نجاح هذا الأسلوب مرهون بمجموعة من المعطيات المتعلقة بالسلطة المفوضة والمفوض له، أهمها تكريس نظام قانوني يضمن حسن اختيار المفوض له وفق مبادئ المنافسة والشفافية، ويضمن حسن تنفيذه وفقا للمبادئ العامة المتصلة بعمل المرفق العام . This study aims to determine the general framework of the technical delegate of public service in Algeria, a new and independent concept frames the range of contracts in accordance with legal foundation, bet on him to expand of investment in the field of public service. And it affected the French experiment. Which is known as the public facilities, the development of very effective since the adoption of this method of management in order to achieve as many positive results. Nevertheless, the success of this system is closely related to many criteria linked to the delegate authority as well as to the delegated person himself among these criteria we can notice the Implementation of a legal regime that guarantees the good choice of the delegated person, according to the principles of competition and transparency but that should essentially guarantee its good execution according to general principles related to the function of the public service .
