    Pratique De L’arbitrage International En Algérie : Enjeux Et Modernisation

    A l’instar des autres pays, l’Algérie a adopté la conception dualiste de l’arbitrage, avec un régime juridique réservé à l’arbitrage interne et un autre destiné à réglementer l’arbitrage international par des dispositions particulières (Titre II Chapitre IV du CPCA). Ce qui laisse supposer une plus grande faveur pour l’arbitrage international dont le régime juridique est moins contraignante que celui de l’arbitrage interne. Ce droit de l’arbitrage parvenu certes à un stade en évolution vers la modernité ne comporte pas moins certaines lacunes que le législateur ne manquera pas de combler au gré de l’expérience de la pratique. Like the other countries, Algeria has adopted the dualistic conception of arbitration, with a legal regime reserved for internal arbitration and another intended to regulate international arbitration by specific provisions (Title II Chapter IV of the CPCA). This suggests a greater favor for international arbitration, whose legal regime is less restrictive than that of internal arbitration. this law of arbitration, which has certainly reached a stage in evolution towards modernity, nevertheless has certain shortcomings, which the legislator will not fail to fill with the experience of practice................................................................................................. .Abstract: Like other countries, Algeria has adopted the dualist conception of arbitration, i.e. a legal regime reserved for internal arbitration and another intended to regulate international arbitration by specific provisions (Title II Chapter IV of the CPCA).
