    التجديد في التفسير عند الفكر الحداثي المعاصر من خلال تطبيق نظرية المقاصد وآثار ذلك في الأحكام القرآنية

    ملخص: تعد نظرية المقاصد من أهم النظريات التي تساهم في تجديد التفسير عند الفكر الحداثي، لذا اشتدت دعوتهم إلى ضرورة تفعيلها وفهم القرآن وفقها، وتعتبر تأرخة التراث وتحكيم الواقع وسلطة المصلحة من أهم مرتكزات تجديد التفسير عندهم بما يتناسب والتغيرات الزمكانية ومصالح الناس المتجددة عبر تجاوز الموروث المتعارض معهما، وكان لهذا التجديد وفق المقاربة المقاصدية الحداثية أثر على الأحكام القرآنية وفق منهج يتجاذبه طرفان؛ طرف يسعى للوصول إلى أحكام تتوافق مع القوانين العالمية منطلقا من أيديولوجيات غربية، وطرف يسعى لتجاوز الأزمة الفكرية عبر تمحيص التراث وتوسيع دائرة حرية العقل في الانتقاد والقبول والرفض، ولأن القرآن حوى مقاصد الشريعة وحكمها؛ فالدعوة إلى رعاية هذه المقاصد ليست حكرا على المشروع الحداثي بل اهتم بها العديد من المفسرين والمفكرين المعاصرين مع ضبط مفهوم المصلحة وحدودها والتفريق بين المقاصد الثابتة والوسائل المتغيرة للوصول إلى فهم مسعف للمسلم مواكب للواقع محافظ على الثوابت. Abstract: The purpose theory is one of the most important theories that contribute to the renewal of Tafsir in modern thought, so it could be needed to activate and understand the Quran, and the field of historiography of cultural heritage, the arbitration of reality and the authority of interest which is considered as a one of the most important pillars of the renewal of Tafsir in proportion to the changes in time and space and the renewed interests of people by transcending the conflicting heritage, and this renewal according to the modern Maqasid view had an impact on the Quranic rulings according to the approach that attracts two parties; one party seeks to reach Quranic rulings that comply with international laws based on ideologies a party that seeks to overcome the intellectual crisis by scrutinizing the heritage and expanding the circle of freedom by means a criticism, and this seeking to care for these purposes is not exclusive to the modern project, but many contemporary scholars have paid attention to it, while adjusting the concept of interest and its limits and differentiating between fixed and changeable purposes to reach a helpful understanding of the Muslim that keeps pace with reality and preserves constants.
