    حماية حقوق المهاجرين غير الشرعيين في ظل مكافحة جريمة الهجرة غير الشرعية في الصكوك الدولية والتشريع الجزائري

    يتناول هذا البحث ماهية الهجرة غير الشرعية التي انتشرت على الصعيد العالمي خاصة في الدول التي تشكل بلدان منشأ لها أو عبور، فألقت بظلالها القاتمة على كل المجتمعات الغنية منها والفقيرة دون أغفال للمجتمع الدولي ما ألزم أعضاءه بالتعاون لمواجهة هذه الأضرار والتخفيف من حدتها دون مساس بحقوق المهاجرين غير الشرعيين. كما يبين أن هذه الفئة ليست متهمة بجرم الهجرة غير الشرعية وإنما هم ضحايا ظروف اضطرتهم للهجرة من بلدانهم، فوجبت حمايتهم ورعاية أهم حقوقهم في ظل قوانين مكافحة الهجرة غير الشرعية على الصعيد الدولي والوطني، ساعيا لمعرفة مدى حماية هذه الحقوق في الصكوك الدولية والتشريع الجزائري.This study examines the illegal immigration that has spread globally, especially in the countries of origin or transit, and has cast a dark shadow over all rich and poor societies, without neglecting the international community, which obliged its members to cooperate to confront and mitigate these damages without prejudice to the rights of migrants. It also shows that this group is not accused of the crime of illegal immigration, but they are the victims of conditions that forced them to emigrate from their countries, and their protection and care of their most important rights under the laws of combating illegal immigration at the international and national levels.
