    إن حق اللجوء للقضاء للمطالبة بالحماية القانونية حقا مكفول لكل فرد يمارسه بمقتضى الوسائل والإجراءات القانونية، وتشكل الدعوى الوسيلة القانونية لممارسة حق التقاضي وأن استعمالها للمطالبة القضائية لم يتركه المشرع لإرادة الأفراد وإنما أحاط استعمال هذا الحق وفقا لإجراءات وشروط قضائية معينة وهذا حرصا لحسن سير الخصومة ومراعاة لتطبيقات النظام العام سواء تعلق الأمر بقواعد الإختصاص الإداري محور ورقتنا البحثية أو بالشروط المتعلقة برفع الدعوى الإدارية. :Abstract The right to resort to the judiciary to claim legal protection is a right guaranteed to every individual who exercises it according to the legal means and procedures. The lawsuit constitutes the legal means to exercise the right to litigate, and its use of the judicial claim did not leave it to the will of individuals.
