    أساس تحديد القانون الواجب التطبيق على عقود التجارة الدولية الإلكترونية

    قد عرف المجتمع الاقتصادي قفزة نوعية في شتى المجالات، ساهمت فيها وبشكل فعّال وسائل التكنولوجيا الحديثة. لينعكس ذلك على المعاملات التجارية، حيث تسارعت وتيرتها، واتسعت رقعتها. وهو ما دفع بالدول ومختلف الهيئات والمنظمات إلى مباشرة الإصلاحات التشريعية في هذا المجال خاصة فيما يتعلق بالجانب التعاقدي منها، وذلك بغية وضع إطار قانوني يضمن حماية للأفراد واستقرار للمعاملات، وهو مالا يمكن أن يتحقق إلاّ من خلال تحديد قانون العقد. هذا الأخير وإن تعددت المناهج بشأنه إلا أنّ الغالب يُرجح فرضية إطلاق العنان لحرية الأطراف في اختياره. غير أنّ المسألة قد يشوبها الكثير من الغموض نظرا لخصوصية الوسط الإلكتروني.The economic community has known a quantum leap in various fields, in which the means of modern technology have contributed effectively. This was reflected in business transactions, where their rate has accelerated and their spread has widened. This has led the States and various institutions and organizations to initiate legislative reforms in this field, especially with regard to their contractual aspects, with a view to establishing a legal framework that guarantees the protection of individuals and the stability of transactions, which can only be achieved through the determination of the contract law. Although many approaches are different, most of them are likely to unleash freedom of the parties to choose them. However, the aforementioned issue may be too vague because of the privacy of the electronic domain.
