    شروط الاجتهاد عند الإمام الشاطبي من خلال كتابه المىافقات

    إن من أىم ما يميز شريعتنا الإسلامية الغ ا رء اىتماميا بمصالح العباد, بل ىدف الشريعة ومجيئيا من أجل ذلك, حيث يتبين أن شروط الاجتياد سمة يجب ألا تفارق أي مجتيد لأن منطق التشريع وجوىره وروحو تنطمق من فيم مقاصد الشريعة والتمكن من الاستنباط بناء عمى فيمو فييا, ىكذا قالو الشاطبي في كتابو الموافقات, وتبعو الكثير من الذين جاؤا من بعده لما وجدوا فيو ب ا رعة استنباط الأحكام الشرعية بالاستق ا رء .وقد تناولنا في بحثنا ىذا: شروط الاجتياد عند الشاطبي فبدأنا بترجمة للإمام الشاطبي في المبحث الأول, وتعرضنا في المبحث الثاني لحقيقة الاجتياد, وكان في المبحث الأخير شروط الاجتياد عند الإمام الشاطبي. ABSTRACTOne of the most important characteristic of our true Islamic Shariaits attention to the interests of its people, but the purpose of the Sharia and it came to this, as can be seen that the conditions of diligenceare characteristic must not depart from any diligentbecause the logic of the legislation and his essence and his spirit begins to understand the purposes of the law and the mastery of deduction based on his understanding of it, so Shatibi said in his bookapprovals(mouafakat), and followed by a lot of who they came after him for what he found in it the Skillto deduce legal rules with the extrapolation. and we hadtaken in our project: conditions of diligencewith Shatibi, we started translating of imam Shatibi in the first section, and we had taken in the second sectionthe truth of diligence, and in last section we had taken conditions of diligencewith Imam Shatby. L'un des caractéristiques importants de la charia islamique, c'est la prise en considération des tous les besoins des gens qui est son objectif principal, ce qui nous apparait que les conditions de l'assiduité qui sont un trait qui doivent se trouver chez n'importe quel assidu puisque c'est la logique et l'âme même de la charia parce qu'ils commencent par la compréhension profonde de la charia et de la déduction par sa compréhension personnelle, ce qu'affirme l'imam chatibi dans son livre Amouafakats et ceux qui suivent et qui ont apprécié son travail qui était basé sur l'induction. Nous avons pris dans notre recherche ceci: les conditions d'assiduité chez l'imam Chatibi. Nous avons commencé par la bibliographie dans le premier chapitre puis nous avons consacré dans le deuxième chapitre pour définir l'assiduité et enfin nous avons conclu dans le dernier chapitre les conditions de l'assiduité selon imam Chatibi.
