    خصوصية التحفظ في اتفاقيات حقوق الإنسان اتفاقية حقوق الطفل أنموذج

    تكتسي اتفاقيات حقوق الإنسان أهمية بالغة نظرا لطبيعة الأحكام التي تحتويها والتي تهدف إلى حماية الإنسان، حفظه ورقيه، ويعتبر الانضمام المكثف إليها من مساعي الأمم المتحدة، حتى تحقق أوسع نطاق ممكن لتطبيقها، إلا أنّ نظام التحفظ ينغص عليها، ويهدد هذا المسعى، نظرا لما يكفله للدول من مخارج قانونية تتملص من خلالها من تطبيق بعض الأحكام المزعجة لها، أو المتعارضة مع أنظمتها القانونية، إلى درجة تصل أحيانا إلى تعطيل المعاهدة بسبب مساس التحفظ بموضوعها وهدفها. ولعل اتفاقية حقوق الطفل من بين الصكوك الدولية التي عانت من التحفظات الماسة بموضوعها وهدفا، والتي حاولت لجنة حقوق الطفل التابعة لها حصرها وتحديدها والعمل على إقناع الدول بسحبها لتضمن لها عالمية التطبيق. Abstract: Human rights conventions are of great importance due to the nature of the provisions they contain that aims to protect human beings, protect them and their advancement, and intensified accession to them is considered one of the efforts of the United Nations, in order to achieve the broadest possible scope for their application, but the reservation system disturbs them and threatens this endeavor, given what it guarantees Countries have legal exits through, which they evade the application of some provisions that are inconvenient to them, or that are inconsistent with their legal systems, to the extent that sometimes reaches the suspension of the treaty due to the reservation affecting its objects and purposes. Perhaps the Convention on the Rights of the Child is among the international instruments that have suffered from severe reservations with regard to its subject matter and objective, and which the Committee on the Rights of the Child has attempted to limit, define and work to persuade states to withdraw it to ensure its universality of application.
