    النظام العام الحمائي وحماية المستهلك

    يعرف السوق بمختلف أنواعه عرض العديد من المنتجات من سلع وخدمات والتي هي من إنتاج وتوزيع الأعوان الاقتصاديين وهو ما سمح لهؤلاء بوضع شروط مسبقة وما على المستهلك إلا قبولها أو رفضها. ويتم وضع هذه الشروط في إطار العلاقة العقدية التي تتم بين العون الاقتصادي والمستهلك وهو ما ولد علاقة عقدية غير متكافئة من الناحية القانونية والاقتصادية معا كون المستهلك يجد نفسه دائما في وضعية خضوع للعون الاقتصادي. وفي سبيل التخفيف من هذه العلاقة غير المتوازنة عملت مختلف التشريعات من بينها المشرع الجزائري على وضع قواعد قانونية لحماية المستهلك من بعض الشروط العقدية التي يفرضها العون الاقتصادي في إطار مفهوم شامل وهو النظام العام الحمائي. Abstract : The market with its different kinds, contains any products and goods produced and distributed by economical agents, that what allowed these agents to put some prior conditions presented to the consumer who may accept or reject them. These conditions are put in the framework of the contractual relation between the economical agent and the consumer which h created a contractual unbalanced relation in the juridical and economical plan because the consumer fin dsimself in a situation of dependency to an economical agent. In order to mitigate this unbalanced relation, the different legislations among which the Algerian legislate or endeavored to put juridical rule to protect the consumer of some contractual conditions that the economical agent impose on the consumer in the framework of a global concept which is General Protectionist System.
