Abstract
يُعَدُّ فقه الموازنات والتكييف الفقهي من المناهج الدقيقة والعمليات المعقدة على المستوى العلمي، توفر للفقه الإسلامي المرونة والحضور القوى في الواقع المتطورة عبر الزمن. ويكمن التحدي الذي يواجه الفقهاء في كيفية البناء على ما قدمه الأوائل، وتفعيل دور التكييف ليتم بذلك الإجابة على أسئلة الواقع ورهانات المستقبل، بالإضافة إلى تمحيص الاجتهادات وتنقيتها. ومرتكز التكييف الفقهي في دراسة القضايا الأسرية النظر فيها بآليات من داخل منظومة الشريعة من مقاصد وتكامل بين النصوص، والبعد عن كل مخالفة للشرع. لذلك جاء هذا البحث مساهمة في إثراء فقه النوازل الأسرية وضبط مناهجها ضبطا يؤدي في كثير من الأحيان إلى التصدي لشذوذات المسائل وأغلوطاتها. Jurisprudence of balances and jurisprudential conditioning is one of the accurate methods and complex processes at the scientific level، providing Islamic jurisprudence with flexibility and a strong presence in reality developed over time. The challenge facing the jurists is how to build on what the early adopters presented، and activate the role of conditioning in order to answer the questions of reality and future stakes، in addition to scrutinizing and purifying the jurisprudence. The focus of jurisprudential conditioning in the study of family issues is to consider them through mechanisms from within the Sharia system of objectives، complementarity between texts، and distance from every violation of the Sharia. Therefore، this research came as a contribution to enriching the jurisprudence of family issues and adjusting their curricula in a manner that often leads to confronting the anomalous issues.
