| dc.description.abstract | إن بحث التأهيل المقاصدي وأثره في صناعة الفتوى، له أهمية كبيرة لضمان قدر كاف من سلامة الأحكام الاجتهادية، ووضوح معالم الفتوى بحيث يصعب تخطيها، إلا بناء على أصول علمية تقتضي ذلك، وهذا كله يمكّن للممارسة الفقهية، ويبعث على الاطمئنان والثقة، ويدعم الاستقرار الاجتماعي. وواقع الفتوى اليوم يشهد كثيرا من الاهتزازات من كثرة التباين فيها، إلى الفتاوى الشاذة، وصولا إلى فتاوى غير المؤهلين... وبناء عليه، سوف نسلط الضوء حول التأهيل المقاصدي وأثره في صناعة الفتوى من خلال عرض معنى المقاصد وبيان أقسامها، ثم أهمية مقاصد الشريعة في تأهيل المفتي لنصل إلى بيان أثر البعد المقاصدي في صناعة الفتوى. The study of Makassed qualification and its impact in the field of fatwa has great importance to ensure adequate safety of discretionary judgments. The reality of the fatwa today witness a lot of disorders, Fatwas anomalous, to fatwas issued by people who are not qualified. Accordingly, this research addresses the Makassed qualification and its impact on the fatwa through the meaning of Makassed ( purposes) and indicate its divisions, then the importance of the Makassed Charia )the purposes of Islamic law ( in the qualification of the mufti. Finally, we show the impact of Makassed dimension (the purpose dimension). | en_US |
