| dc.description.abstract | تحتلّ منازعة التعويض عن نزع الملكية مكانة مهمّة، باعتبار أنها أهمّ الضّمانات لحماية الملكية الخاصّة، وكغيرها من الدعاوى فهي تتطلّب جمله من الشّروط، حتى يتم الفصل فيها، لعلّ أهمّها أن تُرفع الدعوى أمام الجهة القضائية المختصّة التي لها صلاحيّة النّظر في المنازعة وإلاّ تمّ رفضها دون النّظر في الموضوع. إنّ مسألة الاختصاص في هذه المنازعة تعدّ من المسائل المعقّدة، وإسناد النّظر فيها يختلف من نظام قانوني لآخر إذ أنّ لكلّ نظام مبرّراته وكذا نقائصه. Abstract: Lawsuit of Compensation for Expropriation for the public interest occupies a significant standing. As it is one of the most important guarantees of the protection of private property. Like other lawsuits, it requires a set of conditions in order to deal with it. Apparently, the main condition is that it must be filed to a court of law that has jurisdiction over the subject otherwise it will be refused and ruled out without even looking at the matter. Because jurisdiction in a dispute of compensation for the expropriation of real property for public benefit is one of the difficult and thorny issues, it differs from one system to another.
