| dc.description.abstract | مفهوم الأملاك الوطنية الخاصة و التي هي عبارة عن أملاك أو أموال تؤدي وظيفة مالية و تمليكية و هذه الأملاك الوطنية الخاصة على عكس الأملاك العامة و هذا الحق في ملكية الأملاك الوطنية الخاصة مرتبط بمبدأ الإقليمية أي أن الملكية تكون للأشخاص العامة التي لها إقليم خاص بها. هذه الأملاك يتم التصرف فيها بالبيع و يكون أصلا بالمزاد العلني و هذا لإضفاء نوع من الشفافيـــة والمصداقيـة على البيع واستثنــاء يكون بالتراضي وفي حالات محددة قانونا. أما المنازعات التي تثار بشأن بيع الأملاك العقارية الخاصة التابعة للدولة فهي تخضع أصلا لجهة القضاء الإداري. و باعتبار ما للعقار من أهمية بات من الضروري إعادة النظر في طرق البيع بالتراضي و هذا لتشكيل حماية أكبر لها لكونها أضحت عرضة للاستنزاف في ظل النصوص الحالية.
