Abstract
تعتبر غريزة الأمومة أقوى الغرائز عند المرأة وتنصدم عندما تفشل في الإنجاب، لذلك تلجأ إلى كل الطرق كي ترى مولودها، وفي العصر الحديث عرفت مسألة استئجار الرحم من امرأة ثانية مما أثار التساؤلات الشرعية والقانونية حول هذا العقد المستحدث الذي لم يكن معروفا عند المسلمين من قبل، والذي لم تتطرق القوانين المدنية أو الأسرية باعتباره عقدا غير معروف لدى الناس. Abstract Meternity instinct is considered as the strongest instincts in women and she will shocked if she not giving brith so she resort to all round to see her baby. The modern era has know the case of hiving the womb from anather women which sparked sharia and legal question about this modern contract . That was not know among Muslims before who did not write in down civil and Family laws because it is inknow to peoples.
