| dc.description.abstract | سئل أحد علماء المالكية عن اختيارات الأصحاب المتأخـرين كاللخمي وغيره هل تحكى أقوالا في المذهب ؟ قال: نعم، يحـكى ذلك قولا في المذهب، كما يحكى قول من تقدم من الفقهـاء قـولا في المذهب، وهذا الرأي على سبيل النظر؛ لأنه رأى أن كل جواب بني على أصـول مذهب مالك وطريقته والمفتى به في المذهب فيصح أن تضاف هـذه الأقوال إلى المذهب وتعد منه. ونحن في هذه الورقة نتناول وبالإضافة إلى ذلك اعتماد التخريج منهجا للإفتاء في النوازل . Abstract A malekia scientist was asked about the choises of latercomers as : El-lakhmi, had it been considered as opinions in the doctrine ? He said : yes، it had. This opinion is for consideration, because he belived that every answer was based on the malek's doctrine, and this owner, it considers as adjoining opinions . we refer in this paper the adoption of " takhrij " as an approach of advisory opinion in chaos. | en_US |
