dc.description.abstractيعتبر علم الفرائض من أجل العلوم و أشرفها و لأن النفوس جبلت على حب التملك تولى الله تعالى تقسيمه بالعدل بين الورثة ولا شك أن المشرع الجزائري في قانون الأسرة حسب آخر تعديل 27 فبراير 2005 قد خصص لمواد الميراث وحدها ثمانية وخمسين مادة وعشرة فصول ، نحاول في هذه الدراسة إبراز جوانب الفراغ التشريعي في المواد المتعلقة بالميراث إذا ما قارنها بالشريعة الإسلامية ومن أهم ما نلاحظه أن المشرع بدأ مواد الميراث بأسباب الميراث وكان أحرى أن يخصص مواد للتعريف بالتركة وطرق تصفيتها كما نؤكد على ضرورة تعديل المادة 1/49 ق.ا.ج حتى تتماشى مع أحكام الشريعة في الطلاق لأن التوارث بين الزوجين يشترط أن تكون الزوجة في العدة الشرعية فإذا كانت قد أنهت عدتها ولم يصدر الحكم بالطلاق فهي زوجته ترثه قانونا أما شرعا فلا توارث بينهما، كما يظهر موضوع التنزيل لم يحدد المشرع هل هو وصية ويخضع لشروط الوصية أم ميراث ويخضع لشروط الميراث، كما نحا ول في هذه الدراسة إبراز الفراغ التشريعي في حالات ميراث الحمل والمفقود في قانون الأسرة، كما تناولنا في الفرع الأخير الفراغ التشريعي في المسائل الخاصة التي تناولها المشرع الجزائري في خمسة مسائل خاصة فقط. The science of legal obligations is one of the noblest and most honorable sciences, due to the tendency of innate possessiveness in minds, Almighty God has ruled on a sharing, the fairest of the patrimony between the heirs. Without a doubt, in accordance with the amendment of February 27, 2005, the Algerian legislator has devoted fifty-eight articles and ten chapters in the family code to the sole problem of inheritance. Through this research, we aim to highlight aspects of a legislative vacuum relating to these articles in relation to Islamic law. The most important remark to make is that the legislator started with the social names of the inheritance, whereas it was preferable for him to allocate articles to define the goods subject to the inheritance and the means of their liquidation. We then underline the need for a modification of article 1/49 of the family Code, so that it conforms to the modalities of the laws of Sharia, because the inheritance between the spouses in the event of divorce, in accordance with The article raised, requires that the woman be in a period of waiting, and that if this period comes to an end and the divorce judgment is not rendered, she remains his wife, having the right to her inheritance, then that according to Sharia, she is no longer entitled. In the event that the child inherits in place of his deceased father, the legislator has not defined whether the inheritance is subject to the will in the inheritance, or an inheritance subject to the conditions of the inheritance. We will try through this research to highlight the legislative void in cases of inherited pregnancy and missing persons. We devoted the last chapter to special cases, not dealt with by the Algerian legislator, while it was limited to only five special cases.en_US
