Abstract
يهدف هذا البحث إلى بيان وجه الموازنة بين الأحكام في بعض نوازل جائحة كورونا، وذلك من خلال ثلاثة مباحث، يركز الأول على مفهوم فقه الموازنات، والثاني على ضوابط الموازنة بين المصالح والمفاسد، أما الثالث ففيه مسائل مختارة من نوازل جائحة كورونا وبيان أحكامها من خلال فقه الموازنات، وهذا يتطلب اتباع منهجي الاستقراء والاستنباط. وأهم نتائجه: فقه الموازنات يمثل المنهجية المنضبطة التي يدفع بها التعارض بين الأحكام المختلفة والمتفاوتة كالتي أفرزتها جائحة كورونا، وله ضوابط للموازنة بين المصالح فيما بينها، وضوابط للموازنة بين المفاسد فيما بينها، وأخرى للموازنة بين المصالح والمفاسد المتعارضة. وتمثل ميزانا شرعيا محكما يهدي المجتهدين إلى الحكم الشرعي الصحيح Abstract This research aims to clarify the aspect of the balance between the provisions in some of the calamities of the Corona pandemic, through three investigations, the first focuses on the concept of the jurisprudence of budgets, and the second on the controls of the balance between interests and evils, and the third includes selected issues of the calamities of the Corona pandemic and its provisions through the jurisprudence Balances. This requires an induction and deduction approach. And its most important results: The jurisprudence of budgets represents the disciplined methodology by which the contradiction between different and disparate provisions, such as those produced by the Corona pandemic, is pushed against, and it has controls for the balance between interests between them, and controls for balancing the evils between them, and others for balancing the conflicting interests and evils. And it represents a tight legal balance that guides the diligent people to the correct legal ruling
