Abstract
لتحقيق إستقلالية القضاء وتحقيق العدالة, يجب توفر ضمانات تحمي القضاة, وتضمن لهم إستقلاليتهم, وذلك من خلال الدستور والقوانين المتعلقة بهذا الموضوع, القانون الأساسي للقضاء والقانون العضوي المتعلق بالمجلس الأعلى للقضاء, وإن إستقلالية القضاء تظهر من خلال عنصرين أساسيين هما: الإستقلال العضوي للقضاء, والإستقلال الوظيفي.
يقصد بالإستقلال العضوي للقضاء هو عدم السماح لأي سلطة غير قضائية بالتدخل في إدارة المسار المهني للقضاة وهو ما يستدعي وضع كل ما يتعلق بالمسار المهني للقضاة في يد المجلس الأعلى للقضاء, و إبعاد أي سلطة أخرى عن التدخل فيه, بالإضافة إلى ضمانات إدارة المسار المهني للقضاة فيجب تحسين الوضع
In order to achieve independence of the judiciary and justice , there must be guarantees that protect the judges and ensure their independence theough the constitution and the laws related to this lopic which are : the basic law of judiciary and the organic law related to the supreme council of judiciar.
This the independence of the judiciary manifests through two basic elements: The organic and functional independence of the judiciary which means to prevent any non judicial authority from interfering in the management of the professional course of the judges, this later requires placing all the professional career of the judges in the hands of the Supreme Judicial Council and preventing any other authority from interfering in it.
In addition to that, the social status of the judges must be improved, and all the appropriate requirements must be provided to them, so that they will perform their tasks in the best possible way. The functional independence of the judiciary manifests through applying the law, which any direct or indirect restrictions, threats or pressures to solve the disputes which are displayed to the judiciary. Moreover, the neutrality and the well formation of the judge must be ensured.
All of this above should be accompanied by securities to ensure this independence which will lead to justice and thereby achieving public freedoms for the individuals.
