Abstract
الملخص:
تعتبر جريمة التشهير من الجرائم التي تمس الحياة الخاصة، وهي اعتداء على الحقوق الشخصية، ومع التطور التكنولوجي واستخدام الإنسان لمواقع التواصل الاجتماعي، أصبح فيما يعتبر من الحياة الخاصة سهل التداول عبر هذه المواقع، وهو مما يسهل انتشار خصوصيات الناس بسرعة ويسر، لذا جاءت هذه الدراسة لتبين خطورة هذا النوع من جرائم التشهير والذي يسمى التشهير الإلكتروني، وأردنا طرح الإشكالية الآتية:" ما موقف الفقه الإسلامي والقوانين الوضعية من جريمة التشهير الإلكتروني"؟
وللإجابة عن هذه الإشكالية تم التطرق إلى مفهوم التشهير الإلكتروني، ثم ذكر أنواعه والأركان التي يقوم عليه جريمة التشهير الإلكتروني، كما أبرزت هذه الدراسة أهمية تجريم التشهير الإلكتروني، والقواعد الإجرائية لهذه الجريمة، ثم ختمت بالسبل التي يجب توفرها للوقاية من جريمة التشهير الإلكتروني، وكان من أهم النتائج المتوصل إليها:
-الاعتداء على سمعة الإنسان باستخدام وسيلة الأنترنت سواء تعلق الأمر بالسب أو القذف أو الإهانة والتحقير أو بإفشاء أسراره أو نشر أكاذيب مغلوطة أو غيرها، هو مناط جريمة التشهير الإلكتروني.

Abstract;
The crime of defamation is one of the crimes that affect private life, and it is an attack on personal rights, and with the development of technology and human use of social networking sites, what is considered private life has become easy to trade through these sites, which facilitates the spread of people’s privacy quickly and easily, so this study came To show the seriousness of this type of defamation crime, which is called electronic defamation, and we wanted to raise the following problem: “What is the position of Islamic jurisprudence and man-made laws on the crime of electronic defamation”?
In order to answer this problem, the concept of electronic defamation was discussed, then it mentioned its types and the pillars on which the crime of electronic defamation is based. The most important results obtained:
Attacking a person’s reputation using the Internet, whether it is insulting, slandering, degrading, disclosing his secrets, spreading false lies, or others, is the basis for the crime of electronic defamation.
