صالحي, خالد2021-06-082021-06-082020http://dspace.univ-eloued.dz/handle/123456789/8978مذكرة ماستر تخصص معاملات مالية معاصرةيعالج هذا البحث موضوع غرامة التأخير، أحكامها الفقهية وآثارها الاقتصادية، إذ حاول الإجابة عن الإشكالية التالية: ما هي الآثار الاقتصادية لغرامة التأخير؟ وما هو أثر الأحكام الفقهية عليها؟ وتم تقسيم هذا البحث إلى ثلاثة مباحث، حيث عالج المبحث الأول مقدمات عامة حول الغرامات المالية، كما عالج المبحث الثاني حكمها الشرعي، في حين عالج المبحث الثالث واحدا من أهم الغرامات المالية حضورا في حياة الناس الاقتصادية، وهي غرامة التأخير؛ وخلصت في الأخير إلى خاتمة تضم أهم النتائج والتوصيات، من أهمها: أن أصل التغريم بالمال جائز شرعا، في حين أن غرامة التأخير الراجح فيها التحريم، إلا في حالات استثنائية محدودة."This research deals with the subject of financial fines their jurisprudential provisions and their economic implications trying to answen the following questions: what are the economic effects of financial fines? And what are the effects of jurisprudential provisions on them? This research is devided into three classes, the first deals with the de finition of financial fines, the second deals with their jurisprudential provisions.
