عمارة, رزوق2023-06-102023-06-102022م.إ.ق22https://dspace.univ-eloued.dz/handle/123456789/26029مذكرة ماسترشهدت الجزائر مؤخرا تحولات سياسية هامة صاحبتها إصلاحات دستورية كانت لها انعكاسات قانونية على المنظومة الانتخابية تهدف إلى ضمان حماية وسلامة العملية الانتخابية من أي اعتداء يؤثر سلبا على نزاهتها ومصداقيتها ويعتبر القانون العضوي رقم 21-01، المؤرخ في 16 رجب 1442ه الموافق لـ 10 مارس 2021. المتعلق بنظام الانتخابات النص المرجعي والاساسي في تنظيم وضبط الجرائم الانتخابية والحماية الجزائية المقررة للانتخابات في الجزائر. وتناولت هذه الدراسة موضوع الجرائم الانتخابية اثناء مرحلة الاقتراع في التشريع الجزائري ووفقا لهذا القانون للوقوف على مدى اسهام وكفاية النصوص الجزائية الانتخابية لمواجهة ما قد يشوب العملية الانتخابية من تجاوزات او انتهاكات لنظام الانتخابات خاصة أمام تنوع أساليب ارتكاب هذه الجرائم الانتخابية ، الامر الذي يستدعي تعديل هذه النصوص الجزائية ام انه يتطلب استحداث نصوص جزائية جديدة تتلاءم مع خصوصية وطبيعية الاجرام الانتخابي بغرض ضمان حماية جزائية فعالة وحقيقية للعملية الانتخابية عبر جميع مراحلها. Algeria has recently witnessed important political transformations accompanied by constitutional reforms that had legal repercussions on the electoral system aimed at ensuring theprotection and integrity of the electoral process from any attack that negatively affects its integrity and credibility. Organic Law No. 21-01, dated Rajab 16 1442 AH corresponding to March 10, 2021, is considered. Relating to the electoral system, the basic and reference text for organizing and controlling electoral crimes and the penal protection for elections in Algeria. This study dealt with the issue of electoral crimes during the voting phase in the Algerian legislation and in accordance with this law to determine the extent of the contribution and adequacy of the electoral penal texts to confront the excesses or violations of the electoral process that may mar the electoral system, especially in view of the diversity of methods of committing these electoral crimes, which calls for amending these texts.
