[أكتب تاريخ الاطلاع] متاح على الرابط[أنسخ رابط التحميل2588-1736https://dspace.univ-eloued.dz/handle/123456789/32182مقالتهدف هذه الدراسة إلى النظر في قرارات اللجنة المصرفية القابلة للطعن أمام مجلس الدولة، كون هذه اللجنة تعد أهم هيئة رقابة مصرفیة، منحها المشرع سلطة اتخاذ القرارات وإصدارها ما يجعل قابلية الطعن في قراراتها من أهم المواضيع الجديرة بالدراسة. وكنتيجة لهذا نجد أنه لابد من إعادة النظر في تشكیلة هذه اللجنة ودعمها بذوي الكفاءات من أستاذة التعلیم العالي المتخصصین في المجال البنكي، لوضع التكامل بينهم وبین القضاة وذوي الكفاءات في المجالين المالي والاقتصادي والذین یمثلون الجانب العملي، ومراجعة المنظومة المصرفیة بإضافة مواد تتعلق بتنظیم المعاملات المصرفیة الإلكترونیة، ووضع هيئات للرقابة عليها بشكل من التفصیل آخذة بنموذج الدول الرائدة في هذا المجال. Abstract: The objective of this study is to consider the decisions of the Banking Commission, which can be appealed to the Council of State, as the most important banking control body, which has been given by the legislature the authority to make decisions and issue decisions, making the appeal of its decisions one of the most important subjects to be considered. As a result, the composition of this commission should be reviewed and supported by the qualified specialists of higher education in the banking field to integrate them with the judges, financial and economic professionals who represent the practical side, and the review of the banking system by the addition of materials on the regulation of electronic banking transactions.
