[ أكتب تاريخ الاطلاع] متاح على الرابط [أنسخ رابط التحميل]2477-9954https://dspace.univ-eloued.dz/handle/123456789/15971مقالتهدف هذه الدراسة إلى بيان العلاقة بين الاجتهاد التنزيلي ،و فقه السنن الإلهية في القرآن الكريم من خلال تطبيق هذا الفهم في إدراك واقع التكليف بمستوياته المتعددة ،حال المخاطب ،وبيئة الخطاب ، و أحوال الوقائع و المستجدات ،وفق أسس علمية تجمع بين القوانين الشرعية الإلهية و الرصيد الفكري الإنساني . ذلك أن أهم أسس عملية التنزيل الفهم الصحيح لموضوع الحكم و محله ،بما يحقق الموافقة بين المقصود الشرعي وعملية تطبيق الاحكام الشرعية ، وعليه تضاف هذه الدراسة للدراسات التأصيلية المنهجية ،التي تعالج إشكالات التنزيل وفق رؤى متعددة من بينها الاتجاه السنني الذي يؤكد على ضرورة الانطلاق من القوانين الإلهية و العوائد الشرعية في تحقيق الملاءمة بين منظومة التشريع وواقع المكلفين . Abstract The present study aims to shed light on the relationship between the revealed Juristic deduction and the jurisprudence of the divine laws procedures in the Holy Qur’an through the application of this understanding in realizing the reality of the ordinance at its multiple levels, the addressee’s situation, the discourse environment, and the conditions of facts and developments, according to scientific foundations that combine divine customary procedures and balance the human intellectual, for the reason that the most important foundations of the revelation process is the correct understanding of the subject and place of the ruling, in order to achieve agreement between the legal intent and the process of applying the legal rulings.
