عطوي, مريم2023-03-282023-03-282017-12-31عطوي، مريم. ردع الجريمة البيئية وفقا للقانون الجزائري. مجلة العلوم الإدارية والمالية. مج 01. العدد01. 2017/12/31 . جامعة الوادي [اكتب تاريخ الاطلاع] متاح على الرابط [انسخ رابط التحميل]2602-6139http://dspace.univ-eloued.dz/handle/123456789/18536مقالاعتمد المشرع سياسة جنائية بسيطة في مجال الحد من الجريمة البيئية، لا تتوافق مع درجة الخطر الذي ترتبه الأفعال المرتكبة في حق البيئة وأمن المجتمع، فنجد أنه لم يخرج من التصنيف التقليدي للجرائم،أما فيما يخص مسؤولية الشخص المعنوي فنجد أنه أصاب في الأخذ بازدواجية المسؤولية للشخص الطبيعي والمعنوي، رغم أنه استثنى الشخص المعنوي الخاضع للقانون العام، ولم يراع في العقوبات المفروضة على الشخص المعنوي خصوصية الجريمة البيئية والأضرار المترتبة عنها، ولم يأخذ بنظام التشريع الموحد في مجال البيئة حيث ظلت القوانين المتعلقة بالبيئة متفرقة بين القوانين والمراسيم العديدة والمتنوعة، لذلك على المشرع السعي إلى اعتماد سياسة جنائية أكثر تطورا في ميدان حماية البيئة، واستحداث حلول قانونية أكثر ملاءمة للمشاكل المطروحة في مجال حماية البيئة. The Algerian legislator has adopted a simple criminal policy concerning the limitation of environmental crime, which does not suit the degree of risk resulting from acts committed against the environment and the society security, he did not go very far from the classification of traditional crimes, and as far as the responsibility of legal person the legislator managed to take a double responsibility natural person and moral, although it has excluded the public moral person, and it does not take into consideration the sanctions imposed on the legal person the specificity of the environmental crime and the damage caused by, it did not take into account the unified environmental legislation, since the laws relating to it are scattered among other laws and decrees.
