[أكتب هنا تاريخ الإطلاع]. متاح على الرابط [انسخ هنا رابط التحميل].https://dspace.univ-eloued.dz/handle/123456789/33790ماستر"إن هذا البحث الموسوم بالاختيارات الفقهية للإمام الفاكهاني من خلال كتابه رياض الأفهام – من كتاب القصاص إلى كتاب الحدود – كان الإشكال الرئيس الذي يرنو للإجابة عنه هو : ما مدى إلتزام الإمام الفاكهاني بالمذهب المالكي في اختياراته الفقهية من خلال كتابه رياض الأفهام في شرح عمدة الاحكام من -كتاب القصاص إلى كتاب الحدود ؟-، وقد أجاب هذا البحث على ذلك الإشكال من خلال المبحثين الآتيين: أما الأول فقد تضمن ترجمة للإمامين الفاكهاني والمقدسي، والتعريف بكتابيهما، ثم المبحث الثاني وفيه معنى الاختيارات الفقهية، و المصطلحات ذات الصلة، و منهج الفاكهاني في اختياراته الفقهية، ودراسة بعض المسائل في كتابي القصاص والحدود، وهل وافق فيها المذهب أم خالفه . وفي الختام توصلنا إلى مجموعة من النتائج والتوصيات، فأما النتائج أهمها: أن الإمام الفاكهاني لم يلتزم في اختياراته الفقهيه بالمذهب المالكي بل خالفه في بعض المسائل، وهذا إن دلّ على شي فإنما يدل على عدم تعصبه لآراء الإمام مالك، ومن بين التوصيات التي نوصي بها طالب العلم هي: دراسة تأثير اختيارات الإمام الفاكهاني على الفقه الإسلامي، التعمق في الخلاف النازل لمسائل القصاص والحدود خصوصا وهو باب مهم جدا وله أثر في الواقع، تركيز الدراسات اللاحقة على مسائل الخلاف النازل بين علماء المذهب. This research paper is an exploratory study entitled The Jurisprudence Selections of Al-Emam Al-Fakehani through his book Riyad Al-Afham or (The Awareness Meadow). It is based on the following question: To what extent was Al-Emam Al-Fakehani committed to the Maliki approach in his jurisprudence Selections through his book Riyad Al-Afham or (The Awareness Meadow in explaining the Master of Judgments from the retaliation (Alqisas) section to the fixed punishments (Hudud) section? This research paper answered that question through the following two chapters. The first chapter introduces Al-Emam Al-Fakehani and Al-Emam Al-Maqdisi and identifies their books. The second chapter represents the meaning of the jurisprudence selections, the relevant concepts, and Al-Fakehani’s approach of selecting and studying some issues in both the retaliation (Alqisas) section and the fixed punishments (Hudud) section. It also examines the extent he agreed or opposed the Maliki approach. At the end, we present certain results and recommendations. We concluded that Al-Emam Al-Fakehani did not follow the Maliki approach and he disagreed with a number of issues. This proves that Al-Emam Al-Fakehani is not strict to the Maliki approach. We recommend studying the influence of Al-Emam Al-Fakehani’s selections on the Islamic jurisprudence, making more studies on the disagreement about retaliation (Alqisas) and the fixed punishments (Hudud) as it is a very important issue in our life.
