Jurists agreed on the legitimacy of comfort and have unanimously agreed that the Quranic verses from al-Baqarah and Al-Ahzab surahs provide evidence for its legitimacy. However, the disagreement was on the degree of its legitimacy and criteria. “Compensation " on the other hand is a new term for contemporary jurists; it was initially known as “guarantee.” 13111011301452020 The Algerian legislators dealt with the issue of compensation for arbitrary divorce in Part II and article 52 of the Algerian family law, but they did not mention the topic of comfort. The Supreme Court decisions, however, ruled for comfort, but confusion occurred between both rights (comfort and compensation (, given the convergence between them and that they share the cause of reparation. The Court sometimes rules for of comfort and sometimes for compensation, and at other times rules for both.
