Abstract
إن الترشح حق سياسي يهدف للوصول إلى السلطة عند انتهاء العهدة الانتخابية أو إنهاءها ، يترتب عنه آثار ايجابية متمثلة في الضمانات والحقوق الممنوحة للمترشح ، أما الآثار السلبية فتبرز في تلك الالتزامات الملقاة على عاتق المترشح والقيود التي يترتب عنها إنهاء الترشح ، كما تظهر الشروط الخاصة للترشح التي تتصدرها شروط الترشح لانتخابات رئيس الجمهورية باعتبارها أكثرها شروطا مقارنة بغيرها ثم تأتي شروط الترشح لانتخابات مجلس الأمة المتميزة بطابعها غير المباشر وتتشابه شروط الترشح لانتخابات المجلس الشعبي الوطني والمجالس الشعبية الولائية والبلدية إلى حد قريب ، أما الإجراءات الخاصة بانتخاب رئيس الجمهورية فيتم الإشراف عليها من قبل السلطة الوطنية المستقلة للانتخابات وتحت رقابة المجلس الدستوري أما إجراءات الترشح لباقي الانتخابات تتم على مستوى الولاية وتختص المحاكم الإدارية بالطعون المتعلقة بها Candidacy is a political right that aims to reach power at the end of an electoral mandate or after its termination. It will have positive effects represented in the guarantees and rights given to the candidate. Its negative effects arise in the obligations incumbent on the candidate and the restrictions that involved the candidacy termination. The special conditions for candidacy become apparent, and the most conditional ones are those of the presidential elections. The conditions for the National Assembly elections are distinguished by its indirect nature. The conditions for the National People's Assembly elections and the state and municipal people's assemblies are similar. Concerning the specific procedures to elect the president of the republic, it has to be supervised by the Independent National Authority for Elections and under the supervision of the Constitutional Council. For the rest of other elections' candidacy procedures, they take place at the state level and the administrative courts hold its appeals' competence.
