Abstract: نجد أن معظم القوانين والتشريعات في العالم أعطت أهمية كبيرة لتنظيم المعاملات العقاري وضبطها، من أجل ضمان وتحقيق الاستقرار، وظهر ذلك جليا من خلال نظام الشهر العقاري الذي تبنته معظم الدول. ولقد تبنى المشرع الجزائري نظام الشهر العيني رسميا بموجب الأمر (74/75) المؤرخ في 12/11/1975 المتضمن إعداد مسح الأراضي العام وتأسيس السجل العقاري والمرسومان التنفيذيان له. ولكون عملية مسح الاراضي العام بقيت تسير بوتيرة ضعيفة، فقد حاول المشرع الجزائري التدخل لتطهير الوضعية العقارية في المناطق غير الممسوحة، وذلك بموجب القانون رقم (07/02) المؤرخ في 27/02/2007، المتضمن تأسيس لإجراء معاينة حق الملكية وتسليم سندات الملكية عن طريق تحقيق عقاري، وذلك بواسطة طلب يقدم إختياريا عكس عملية المسح العام التي تكون إجبارية . حيث بعد أن تنتهي هذه العملية يتم إيداع الوثائق المسحية لدى المحافظ العقاري، الذي يتولى مباشرة تأسيس السجل العقاري وإجراءات القيد الأول باتباع الترقيم العقاري، فقد يكون الترقيم مؤقتا لمدة 04 أشهر ، أو ترقيما مؤقتا لمدة سنتين، وقد يكون ترقيما نهائيا كما قد يتم ترقيم العقار في حساب المجهول. أما في حالت التحقيق العقاري فتفضي العملية غالبا إلى تسليم مقرر الترقيم العقاري محل التحقيق، أو إلى تسليم مقرر رفض الترقيم في حال خلص التحقيق إلى نتيجة سلبية، ويمكن اللجوء إلى القضاء المختص للطعن في هذه القرارات. ومن خلال التحول من نظام الشهر الشخصي إلى نظام الشهر العيني، قد ينتج عن ذلك عدة إشكاليات، من بينها تسجيل حقوق عقارية باسم غير مالكيها او من يحوزها نتيجة تغيبهم عن أعمال المسح فترقم لصالحهم. وعليه فقد تثار عدة منازعات عن طريق رفع دعاوى عقارية تخضع لعملية الشهر تحت طائل البطلان، يتراوح الفصل فيها بين اختصاص القضاء العادي وجهات القضاء الإداري. تأسيسا على ذلك ورغبة منا في المساهمة بجهد محدود في إثراء المكتبة القانوني، فقد آثرنا أن يكون موضوعنا " منازعات الترقيم العقاري في التشريع الجزائري ".، الذي ينظر إليه على انه جزء خاص من القسم العام لمنازعات الشهر العقاري. وللأهمية البالغة لمنازعات الترقيم لكونها ذات خصوصية لارتباطها بالحفاظ على الملكية العقارية وحمايتها، ولكثرة إجراءاتها وتشعبها وغموضها أحيانا لدى المواطن العادي ارتأينا في دراستنا هذه ايضاحها وإجلاء الغموض عليها ليستفيد منها العام والخاص. لكل ما سبق نخلص إلى بعض التوصيات والاقتراحات التي نوجزها كما يلي: - التقليل من الاعتماد على الطرق الكلاسيكية في الإعلان عن افتتاح عمليات المسح، وضرورة استعمال والاستفادة من الوسائط الإعلامية الحديثة مثل الانترنت ومواقع التواصل في إيصال المعلومة إلى الجمهور. - تسريع عملية المسح باستحداث طرق وإجراءات جديدة واستعمال التكنولوجيا الحديثة للتقليل من الأخطاء التي تكون سببا في المنازعات . - إعادة النظر ومراجعة النصوص القانونية والتنظيمية السارية المفعول لا سيما في تشكيل لجنة مسح الأراضي بجعلها أكثر فعالية ومنحها صلاحيات حسم المنازعات بأحكام قضائية لربح الوقت في تطهير الملكية، تخفيف الضغط عن المحاكم . - الأخذ بنتائج محضر التحقيق العقاري ضمن القانون (07/02) عند مرور فرق المسح لتحقيق الهدف من سن القانون ولتسهيل العملية. - لكي تكون محاولة الصلح التي يقوم المحافظ العقاري أكثر فعالية يجب تعديل المادة (15) من المرسوم رقم(76/63) بتحديد أجل محدد لإجراء المصالحة لتقييد المحافظ العقاري ولعدم تعسفه في استعمال حقه. - إلغاء المادة (23) مكرر من الأمر رقم (75/74) المتضمنة في المادة (67) من القانون (14/10) المتضمن قانون المالية لسنة 2015. - إلغاء التكرار الحاصل في قانون الإجراءات المدنية والإدارية بخصوص النص على شهر الدعاوى القضائية من خلال المادة (17) والمادة (519). - العمل على إصدار نص قانوني جامع يحكم الملكية العقارية، الأمر الذي من شأنه المساهمة في التقليل من المنازعات العقارية وتحديد الاختصاص تحديدا دقيقاWe find that most of the laws and legislation in the world have given great importance to the regulation and control of real estate transactions, in order to ensure and achieve stability, and this is evident through the system of real estate month adopted by most countries. The Algerian legislator adopted the system of the month in kind officially under Order (74/75) of 12/11/1975 including the preparation of the survey of the public land and the establishment of the land registry and its executive decrees. As the land survey continued to run at a low pace, the Algerian legislator attempted to intervene to clear the real estate situation in the undeveloped areas under Law No. 07/02 dated 27/02/2007, Through an application that offers an option to reverse the general survey process which is compulsory. After this process is completed, the survey documents are deposited with the real estate governor, who directly establishes the real estate register and the registration procedures by following the real estate numbering. The numbering may be temporary for 40 months or temporary settlement for two years and may be final and the property may be numbered In the anonymous account. In the case of the real estate investigation, the process often leads to the handing over of the decision of the numbering of the real estate under investigation, or to the handing over of the decision to reject the numbering in case the investigation reached a negative result, and recourse to the competent court to challenge these decisions. By switching from a personal month system to a month-in-kind system, this may result in several problems, including the registration of real estate rights on behalf of non-owners or those holding them as a result of absenteeism from the surveys. Therefore, there may be several disputes through the filing of real estate lawsuits subject to the process of the month under the pretext of invalidity, ranging between the separation between the jurisdiction of the ordinary judiciary and the administrative judiciary. Based on this, and in order to contribute a limited effort to enrich the legal library, we have chosen to be the subject of "Real Estate Taxation Disputes in Algerian Legislation", which is seen as a special part of the General Department of Real Estate Disputes. The importance of the numbering disputes because they are specific because they are related to the preservation and protection of real property, and the frequent procedures and their ramifications and ambiguity sometimes in the ordinary citizen, we considered in this study clarification and clarification of them to benefit the public and private. For all of the above we conclude with some of the recommendations and suggestions that we summarize as follows: - To reduce reliance on classical methods in announcing the opening of surveys, and the need to use and benefit from modern media such as the Internet and the sites of communication in the delivery of information to the public. - Accelerate the survey by introducing new methods and procedures and using modern technology to reduce errors that are the cause of disputes. - Review and review the legal and regulatory texts in force, especially in the formation of the Land Survey Committee to make them more effective and give them the powers to resolve disputes by judicial rulings to gain time in purifying property, relieving pressure from the courts. - Taking the results of the real estate investigation record within the law (07/02) when the teams pass the survey to achieve the goal of enacting the law and to facilitate the process. - In order for the reform attempt to be made by the real estate governor to be more effective, Article (15) of Decree No. (76/63) should be amended to specify a specific time period for the reconciliation process to restrict the real estate portfolios and not to abuse his right. - Repeal of Article (23) of Law No. (75/74) contained in Article (67) of the Law (14/10) containing the Finance Act 2015. - Repeal of redundancy in the Civil and Administrative Procedures Law regarding the provision of the month of judicial proceedings through Article 17 and Article 519. - To work on issuing a comprehensive legal text governing property ownership, which would contribute to the reduction of real estate disputes and the precise definition of jurisdiction
